This Offer Agreement (hereinafter referred to as the “Agreement”) has been concluded between the company TM PRODAY.BU, acting on the basis of the legislation of Ukraine, on the one hand, and the individual/legal entity accepting the terms of this offer, on the other hand.
Subject of the Agreement
1.1 The company TM PRODAY.BU offers services for the redemption of computer equipment, including, but not limited to: computers, laptops, tablets, smartphones and other electronic equipment (hereinafter referred to as the “Equipment”).
1.2 An individual/legal entity, accepting the terms of this offer, may send a request for the redemption of his/her Equipment under the conditions established by TM PRODAY.BU.
Request for redemption of equipment
2.1 An individual / legal entity has the right to send a request for the redemption of his / her Equipment using a special form on the website of the company TM PRODAY.BU.
2.2 The request must contain complete and accurate information about the Equipment, including the model, brand, condition of the device and other necessary data.
Evaluation and offer
3.1 Upon receipt of the request, the company TM PRODAY.BU will evaluate the provided Equipment, taking into account its condition, market value and other factors.
3.2 The company TM PRODAY.BU will send an offer to an individual/legal entity to buy back the Equipment, which will indicate the price at which the company is ready to buy back the device.
Acceptance of the offer
4.1 The individual/legal entity has the right to accept or reject the offer of the company TM PRODAY.BU.
4.2 In case of acceptance of the offer, the individual/legal entity undertakes to transfer the Equipment to the company TM PRODAY.BU within a specified period and in a specified place.
Payment and transfer of the Equipment
5.1 Upon receipt of the Equipment, the company TM PRODAY.BU makes payment to the individual/legal entity depending on the conditions specified in the offer.
5.2 The transfer of the Equipment is carried out upon receipt of payment or in another specified manner agreed between the parties.
Withdrawal from the agreement
6.1 The company TM PRODAY.BU has the right to withdraw from the agreement on the redemption of the Equipment in case of revealing inaccurate information, changing conditions or other circumstances that may affect the cost or possibility of redemption of the Equipment.
6.2 An individual / legal entity has the right to withdraw from the agreement before the transfer of the Equipment to the company TM PRODAY.BU.
Confidentiality
7.1 The company TM PRODAY.BU undertakes to keep confidential the information that an individual / legal entity provided when filling out the form on the site.
7.2 The company TM PRODAY.BU undertakes not to disclose, transfer or use the information provided, except as provided by law or with the consent of the individual / legal entity.
Final provisions
8.1 This Agreement is a legal agreement between the company TM PRODAY.BU and an individual/legal entity and regulates the relationship between the parties regarding the redemption of the Equipment.
8.2 This Agreement may be amended or supplemented only by agreement of both parties in writing.
8.3 In case of disputes, the parties will try to resolve them through negotiations. In case of failure to reach an agreement, disputes will be referred to the competent court.
